About these terms
“GYPSIES NATION”, “we”, “us”, and “our” mean the adventure travel business operating from Rishikesh, Uttarakhand, India. “Traveller”, “participant”, and “you” mean the person using the website or named in a booking.
The trip description, written quotation or invoice, these Terms, the Cancellation & Refund Policy, and any activity-specific safety form together form the booking agreement. If an activity-specific written term conflicts with a general term here, the activity-specific term applies to that activity.
Enquiries and booking confirmation
Submitting a website form or WhatsApp message is a booking request, not a confirmed reservation. Availability, price, itinerary, inclusions, exclusions, and payment instructions must be confirmed by our team in writing.
Unless your written quotation says otherwise, a booking is confirmed only after we accept it in writing and receive the required 30% advance. We may release an unpaid slot. The remaining balance and due date will be shown in your confirmation; bookings made close to departure may require full payment.
Prices, payments, and inclusions
- Prices are in Indian rupees unless stated otherwise. Applicable taxes, fees, and payment charges will be disclosed before payment.
- Only the items expressly listed as included in the confirmed itinerary are part of the price. Personal travel to the reporting point, meals outside the itinerary, equipment, insurance, evacuation, tips, and personal expenses are excluded unless stated otherwise.
- A payment is valid only through an account or payment link officially confirmed by us. Never share an OTP, PIN, or password with anyone claiming to represent GYPSIES NATION.
- Failure to pay the balance by the due date may be treated as a traveller cancellation after reasonable notice.
Your information and documents
You must provide complete and accurate names, age, contact details, identity documents, permits, emergency contacts, and relevant health or dietary information by the requested deadline. Tell us promptly if anything changes.
You are responsible for passports, visas, permits, identification, medical certificates, and other documents not expressly arranged by us. Missing, late, false, or incomplete information may prevent participation and may be treated under the Cancellation & Refund Policy.
Fitness, health, and inherent risk
Adventure travel involves inherent risks, including changing weather, altitude, difficult terrain, wildlife, river conditions, falling objects, road travel, limited communications, and delayed access to medical care. We manage foreseeable risks but cannot remove every risk from an outdoor environment.
You must read the difficulty and fitness requirements, prepare appropriately, disclose medical conditions, allergies, injuries, medication, or other information relevant to safe participation, and obtain medical advice where appropriate. Participation may be refused or stopped if the trip leader reasonably believes it is unsafe for you or the group.
Itineraries and outdoor conditions
Itineraries and photographs describe the planned experience, not a guarantee of exact conditions, views, wildlife, weather, accommodation, route, summit, or activity completion. Mountain operations may change due to safety, permits, trail or river conditions, transport, group welfare, or instructions from authorities.
We will make reasonable efforts to provide a safe and suitable alternative of comparable value. A change that does not materially reduce the overall service is not by itself a cancellation.
Minors
A participant under 18 requires prior approval and a consent form from a parent or legal guardian. We may require the guardian to accompany the minor depending on the activity, destination, age, and difficulty. Age limits imposed by law, an operator, an insurer, or a permit authority always apply.
Insurance, emergencies, and evacuation
We strongly recommend travel insurance appropriate for the altitude and activities, including medical treatment, emergency evacuation, trip cancellation, personal accident, baggage, and repatriation where relevant. A policy must not exclude the activity you plan to undertake.
Unless expressly included in writing, rescue, evacuation, hospital, additional transport, accommodation, and repatriation costs are the traveller’s responsibility. In an emergency, you authorise us to arrange reasonably necessary assistance when you cannot do so, but such arrangements do not make us the insurer or medical provider.
Third-party services
We may arrange services delivered by independent guides, transporters, hotels, camps, activity operators, insurers, permit authorities, or other suppliers. Their reasonable safety and operating rules also apply.
We remain responsible for the services we are legally required to provide, but are not responsible for a third party’s independent act or omission beyond our reasonable control, subject always to applicable consumer law.
Cancellation, changes, and force majeure
Traveller cancellations, rescheduling, no-shows, refunds, operator cancellations, and events outside reasonable control are governed by our Cancellation & Refund Policy, which forms part of these Terms.
Events outside reasonable control may include severe weather, natural disaster, flood, landslide, avalanche risk, wildfire, epidemic, transport disruption, civil unrest, government order, permit withdrawal, trail closure, or another event that makes the planned trip unsafe, unlawful, or impracticable.
Personal property and damage
You are responsible for your personal belongings and for equipment issued to you. Tell the team immediately about loss or damage. Reasonable repair or replacement costs may be charged where damage results from deliberate misuse or negligence, excluding normal wear.
Website content and intellectual property
Website text, branding, graphics, itineraries, and original media belong to GYPSIES NATION or their respective licensors. You may use the site for personal trip planning but may not copy, resell, scrape, impersonate, or commercially exploit it without permission.
We will seek appropriate permission before using an identifiable traveller’s photograph or testimonial for promotional purposes. You may withdraw future promotional consent by contacting us.
Liability and your legal rights
Nothing in these Terms excludes liability that cannot lawfully be excluded, limits your non-waivable consumer rights, or excuses our fraud, wilful misconduct, or negligence where the law does not permit it.
To the extent permitted by law, we are not liable for indirect or consequential loss, missed connections, personal arrangements made outside the confirmed package, or loss caused solely by your breach, an inherent risk you knowingly accepted, or an event outside our reasonable control. Any limitation will be applied fairly and in light of the services actually booked.
Complaints and governing law
Raise an issue with the trip leader as soon as possible so it can be addressed on the ground. If unresolved, write to gypsiesnation@gmail.com with your booking details and supporting information. We will acknowledge and investigate the complaint in good faith.
These Terms are governed by the laws of India. Disputes are subject to the courts of competent jurisdiction in Uttarakhand, without limiting any forum or remedy available to a consumer under applicable law.
Changes to these terms
We may update these Terms for future bookings. The version accepted when your booking is confirmed will continue to govern that booking unless a change is required by law or is agreed with you in writing.
